ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.616 of 2016 for the alleged offences under Sections 392 and 34 of the I.P.C. The accused committed theft of 6 1/2 sovereign of gold chain from the defacto-complainant. It is reported that the property has been recovered and handed over to the defacto-complainant. The defacto-complainant does not want to pursue the case any further. There is no Page No.1 of 3
previous or subsequent case against the accused. The accused has been attending the case since 2016.
3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2016, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the case in C.C.No.211 of 2017 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
