Learned Counsel for the Petitioner submits that the petition has been filed to condone the delay of 153 days in filing the Appeal in C.M.A.S.R.No.140065 of 2023.
2. Learned Counsel for the Respondent-2 undertakes to file Vakalat. He has no objection in allowing the petition provided the claim of interest for the period of delay is waived.
3. Considering the submission of the learned Counsel for the Respondent-2, the petition in C.M.P.No.26543 of 2023 is allowed on condition that the Appellant is not entitled to claim interest for the period of delay of 153 days.
4. Registry is directed to number the Appeal if it is otherwise in order and to print the name of the learned Counsel for the Respondent-2, if Vakalat is filed and found proper.
