PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 3 to dispose petitioner's representation dated 10.08.2024 in accordance with law and consequently sanction petitioner's medical expense amount of Rs.1,81,219/- under NHIS ( New Health Insurance Scheme) bearing Id No:CBE/01/PB304/NHIS16/183357 and pass orders. ORDER

By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.

2. This petition is filed seeking to issue a Writ of Mandamus directing the respondents 1 to 3 to dispose petitioner's representation dated 10.08.2024 in accordance with law and consequently sanction petitioner's medical expense amount of Rs.1,81,219/- under NHIS ( New Health Insurance Scheme) bearing Id No:CBE/01/PB304/NHIS16/183357 and pass orders.

The case of the petitioner is that the petitioner is working as a Inspector of Police and he was taken treatment for his illness and sent original medical certificates and bills to the 3rd respondent to sanction the medical expenses of 1,81,218/-, who inturn sanctioned the same and sent a letter to the first respondent vide letter No.Ka.No.J3/13441/2021 on 2/5

26.06.2021 to release the medical insurance amount. Inspite of the same, there was no progress on the part of the first respondent to release the approved amount. Hence, the petitioner gave a representation to the respondents on 10.08.2024 and the same was not considered till date. Hence, this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondents to consider petitioner's representation dated 10.08.2024 and pass orders.

5. The learned Special Government Pleader appearing for the respondents submits that they will consider the case of the petitioner on merits and in accordance with law.

6. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 10.08.2024 and pass orders on merits and in accordance with law within a period of twelve weeks from the date 3/5

of receipt of a copy of this order.

7. With the above observations this writ petition stands disposed of. No order as to costs.
