ORDER
The instant writ petition has been filed with a prayer for mandamus, directing the respondents to take appropriate action upon the petitioner's representation dated 01.06.2023.
2. The learned counsel for the petitioner submits that the petitioner participated in the selection process for school admission under the Government quota and for a scholarship. However, the selection was not conducted properly, as the Committee members allegedly showed personal interest towards known individuals and, in violation of the norms, selected only five students instead of the prescribed six students. In this regard, the petitioner has submitted a representation.
3. At this juncture, the learned Government Advocate appearing on behalf of the respondents submitted that under Section 12(1) (c) of the Right of Children to Free and Compulsory Education Act, 2009, a total of 24 2/6
applications were received for admission to the fourth respondent's school. Out of these, only 18 applicants were present on the date of selection. Among the 18, five were found ineligible due to their residences being located far from the school. From the remaining 13 eligible applicants, six students were selected and admitted to the fourth respondent's school. Therefore, the learned Government Advocate submitted that the petitioner's claim that, only five students were selected is factually incorrect and prayed to dismiss the writ petition.
4. I have given my anxious consideration to either side submissions and also perused the materials available on record.
5. The present writ petition pertains to the academic year 2022-2023, and the main grievance raised by the petitioner is that the fourth respondent has selected only five students instead of six. However, upon perusal of the counter affidavit filed by respondents 1 to 3, it has been clearly stated that six students were selected through the prescribed system. Therefore, this Court absolutely does not find any infirmity in the selection process. In view of the above, there is no question to consider the petitioner's representation dated 3/6
01.06.2023, arise in this matter. At this length of time, this Court, absolutely, does not find any grounds to direct the respondents to consider the petitioner's said representation.
