PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India for a direction, directing the District Munsif (Rent Controller) of Ambattur, Tiruvallur District to dispose of the petition in RLTOP No.25 of 2022 on the file of the District Munsif (rent Controller) Ambattur, Tiruvallur District, within a stipulated time. O R D E R
The civil revision petition is filed for a direction to the Learned District Munsif (Rent Controller) of Ambattur, Tiruvallur District to dispose of the petition in RLTOP No.25 of 2022 on the file of the District Munsif (rent Controller) Ambattur, Tiruvallur District, within a stipulated time.
2. The petitioners are applicants and respondent is the respondent in RLTOP No.25 of 2022 on the file the District Munsif (rent Controller) Ambattur, Tiruvallur District. The petitioners/applicants have filed the said application for eviction against the respondent. The case status of the above application shows that, after the completion of enquiry, the case was posted for issue of service and thereafter for evidence. After completion of evidence, the case was posted for arguments from 30.01.2023 to 28.06.2023. After completion of arguments from both sides, the case was posted for enquiry. After enquiry, the case was posted for orders on 08.08.2023 and thereafter, the case is periodically adjourned for orders.
Under these circumstances, the petitioners have filed this present civil revision petition seeking to dispose of the case within the time frame.
3. Learned counsel for the petitioners submit that the case is periodically posted for orders and still orders have not been pronounced. Hence, he seeks for a direction to the trial court to dispose of the case within the time frame.
4. Heard the learned counsel for the petitioner and perused the materials available on record.
5. Further, pursuant to the direction of this Court, the Registry, on verification through e-filing, has reported that the total pendency of the District Munsif (rent Controller) Ambattur, Tiruvallur District is 467 cases.
6. Considering the total pendency of the cases and also considering the nature of this case that after arguments, the case was posted for orders
on 08.08.2023 and still orders have not been pronounced. Therefore, the District Munsif (rent Controller) Ambattur, Tiruvallur District Court, is directed to pronounce orders in RLTOP No.25 of 2022, within a period of two weeks from the date of receipt of a copy of this order.
7. With the above directions, the civil revision petition is disposed of. There will be no order as to costs.
