SRKV post, periyanaickenpalayam, ..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 4th respondent college to permit the petitioner to take part part in the selection for the post of Principal of the 4th respondent college scheduled to be held on 01.11.2023 or any other date and give appointment to the petitioner as principal of the 4th respondent college based on its newspaper advertisement dated 20.05.2023.

ORDER
The apprehension of the petitioner was that he would not be permitted to take part in the selection process in the post of Principal for the 4th respondent college, scheduled to be held on 01.11.2023. When the writ petition was pending, an interim order came to be passed on 2/6
31.10.2023 in the following manner :- It is the submission of the learned counsel for the petitioner that as per the notification for appointment to the post of Principal (men), the petitioner possesses the minimum qualification of Ph.D in Agriculture subject. The provisional certificate awarding the degree of Ph.D in Optimization of Planting Methods and Weed Management Practices in Rice, which is an agriculture subject, has also been produced before this Court. As per the UGC notification dated 17.03.2017, the Ph.D degree obtained through full time or part time are treated as degree awarded through the regular mode. It is the apprehension of the petitioner that though he possesses the required essential qualification, he may not be called for the interview, which is scheduled to be held tomorrow (01.11.2023).
2. On a prima facie view, since the petitioner possesses the required essential qualification, he may be permitted to participate in the interview scheduled to be held on 01.11.2023 by the fourth respondent college.
3. The fourth respondent would be at liberty to evaluate the petitioner in the interview on its own merits and other qualifications.

4. Post the matter on 16.11.2023.

Today, when the matter was called, both the counsel for the petitioner as well as the 4th respondent, had represented before me stating that in compliance with the orders passed by this Court on 31.10.2023, the petitioner was permitted to participate in the interview on 01.11.2023. As such, the grievance of the petitioner has been redressed and hence, no further orders are required to be passed and accordingly, this writ petition stands closed. Consequently, the connected miscellaneous petitions are closed.
