, Being satisfied with the reasons given in the affidavit filed in support of the above application for issuing subpoena summons to summon the Business Head of the third defendant, I am inclined to allow the application as the first and third defendants have remained ex-parte and the case of the plaintiff is based on a letter creating the charge in favour of the plaintiff by the third defendant on 22.08.2017.

2. Accordingly, the application stands allowed subject to all other rights of the plaintiff in the suit.
