This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 31.07.2024 wherein the petitioner is seeking for transfer and posting in the vacancy or in the arising vacancy to the post of PG Assistant (English) in any one of the Government Higher Secondary School within Salem district.
2. Heard Mr.G.Sankaran, learned Senior Counsel appearing for petitioner and Mrs.S.Mythreya Chandru, learned Special Government Pleader [Edn.] appearing for respondents.
3. The grievance of the petitioner is that her appointment to the post of PG Assistant (English) was delayed only due to the delay caused 2/4
by Teachers Recruitment Board (TRB) and the appointment was granted only after orders were passed by this Court. Therefore, the petitioner contends that if her appointment had taken place at the relevant point of time, she could have got posting at Salem district. However, since there was a delay, the petitioner was posted in a vacancy at Government Girls Higher Secondary School, Avinashi, Tiruppur District. The petitioner made a representation to the first respondent requesting to consider transfer and posting of the petitioner in any one of the Government Higher Secondary School within Salem district. Since the same was not considered, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and the nature of grievance expressed by the petitioner, it is made clear that as and when the transfer counselling takes place, the request made by the petitioner seeking for transfer and posting at any one of the Government Higher Secondary School within Salem district shall be considered on its own merits. Except giving this clarity, no further orders can be passed in this writ petition.
