The petitioner seeks anticipatory bail in Crime No.816 of 2022 registered by the respondent police for the offences punishable under Sections 294(b), 324, 506(ii) IPC.

2. It is stated that the defacto complainant and the petitioner herein had previous enmity while they were each driving a two wheeler and thereafter, it is stated that the petitioner had come back and assaulted the defacto complainant.

3. Taking all the factors into consideration, the Court was under the impression that anticipatory bail could be granted, but it is also informed that earlier the petitioner had filed Criminal Original Petition in Crl.OP.No.472 of 2023 and a learned Single Judge of this Court had granted anticipatory bail on 10.01.2023 and the petitioner had not complied with the conditions therein. Then, the respondents have to 1/3

register a fresh FIR against the petitioner herein under Sections 229A IPC.

4. In view of that particular fact that eventhough the Court had an intention to grant anticipatory bail, it cannot be granted.

5. Accordingly, this Criminal Original Petition is dismissed. 09.11.2023 Vv 2/3
