ORDER
The Petitioner, who was arrested and remanded to judicial custody on 29.07.2025 for the alleged offences punishable under Section 310(4) of BNS, 2023, in Crime No.400 of 2025 on the file of the respondent police, seeks bail.
2. The case of prosecution is that on 29.07.2025, on secret information from the police informer that are five accused persons involved 1/4
that on 28.05.2025 at about 7.20 AM were inside the BSNL ground at Padiyanallur with a knife and a stick and that it seems that they are hiding to committed some Criminal act. When five people saw us there and tried to run away, the police party tried to catch them. Three of them tried to escape and caught the two remaining accused. When they were checked, A1 had a knife and A2 had a knife. When questioned about it, it was revealed that they had a habit of selling goods and cannabits, and that they did not had money to spend on fun or old cases, so they all are planned to rob people coming towards the Padiyanallur BSNL ground. The adversary A1 voluntarily gave his confession without any threat, harassment or words of encouragement, and since there was no public movement there. Hence this case.
3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that 24 previous cases pending against the petitioner and totally 5 accused, A4 till absconding. He would also submit that if he is released on bail, he would hamper the investigation and tamper the witnesses. However, he would vehemently opposed to grant bail to the petitioner.
5. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering gravity of offences committed by the petitioner and the fact that the petitioner having 24 previous cases, and the investigation is not yet completed and if he is 2/4
released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 10.09.2025 rna Note :
