Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 1st respondent to dispose petitioner's appeal dated 03.05.2024 within a stipulated period of time.

O R D E R

The Writ Petition is filed for the issue of a mandamus directing the 1st respondent to dispose petitioner's appeal dated 03.05.2024 within a stipulated period of time.

2. Heard the counsels on either side.

3. The defence taken by the respondents is that the Commissioner, Land Acquisition is not the competent authority. However, the learned counsel for the petitioner would rely upon the impugned order itself wherein it is stated that the Commissioner, Land Acquisition would be the authority to whom review petition can be filed against the orders of the DRO.

3. Considering the above, the Writ Petition is allowed. A mandamus is issued to the 1st respondent to dispose the petitioner's appeal dated 03.05.2024 within a period of one month from the date of receipt of a copy of this order. In case, the 1st respondent is of the opinion that he does not have a jurisdiction then the issue of 2/4

jurisdiction shall be considered as a preliminary issue and a speaking orders shall be passed. No costs.
