ORDER
Initial remuneration had been admitted to be paid as per the orders passed by this Court dated 03.11.2023. A report has also been filed by the learned Advocate Commissioner seeking assistance of a Chartered Engineer to value the property and also to direct the parties to bear the expenses in that regard. Considering that the preliminary decree has been granted by this https://www.mhc.tn.gov.in/judis
Court on 03.11.2023 and that the learned counsel appearing for the Advocate Commissioner would further submit that without with the help of the Chartered Engineer, the property could not be valued, as the property is covered with debris and hence, the same should also be cleared by the respective parties to the suit. The learned Advocate Commissioner is permitted to engage the services of the Chartered Engineer of her choice for valuing the suit property. She is also permitted to engage a services of third party to clear the premises and she shall ascertain the expenses that could be incurred for such clearing of the debris and intimate the parties, who shall bear the same in the proportion as ordered in the preliminary decree, as and when the same is received in full. The learned Advocate Commissioner shall clear the debris and value the property. The expenses of the Chartered Engineer shall also be borne by the parties in the same proportion.
