The intending plaintiff, in a suit for partition, seeks leave to sue defendants 1, 2, 4 and 5.

2. Learned counsel submits that the suit schedule property is situated within the jurisdiction of this Court. Since defendant 1, 2, 4 and 5 are residing outside the jurisdiction of this Court, the present application is filed.

3. Upon examining the draft plaint, it is evident that the cause of action has arisen within the jurisdiction of this Court. Accordingly, this application is allowed by granting leave to the applicant to sue respondents 1,2,4 and 5 before this Court. Consequently, the Registry is directed to number the suit, if it is otherwise in order.
