ORDER
These two writ petitions are connected and are taken up for disposal by way of this common order.
2. W.P. No.16313 of 2021 is filed by the management, namely the Tamil Nadu State Transport Corporation (Villupuram) Limited Vellore Division, challenging the order passed in C.P. No.100 of 2016 dated 30.06.2020. W.P. No.24250 of 2017 is filed by the workman seeking to grant him the benefits as per the orders passed in the said claim petition.
3. The brief facts leading to the filing of these two writ petitions are that the workman was non-employed. Consequently, he raised a dispute in I.D. No.65 of 1998 and an award was passed on 17.01.2002 in his favour directing reinstatement with back wages. It is stated that W.P. No.29231 of 2003 was filed by the management challenging the said award and the same was dismissed on 28.03.2013. In the said writ petition, while confirming the award of
reinstatement, the back wages were reduced from 100% to 50%. Even thereafter, the workman was neither reinstated nor the arrears were paid to him. As such, the above computation petition was filed, in which the Labour Court computed the benefits and passed the order dated 30.06.2020, which is now again challenged by the management.
4. When the computation petition is filed based on the benefits that got crystallised in the earlier award, there can be no ground for the management to challenge the same once again. In this regard, Mr. Ashwin, the learned counsel appearing on behalf of the management, would submit that with reference to the original award, a writ appeal has been filed and M.P. No.1 of 2014 in W.A.S.R.No.74004 of 2014 for condonation of delay is still pending.
5. Be that as it may, as and when the management gets any favourable order in the writ appeal, they can rely upon the same. As on date, the original award was passed in the year 2002 and 23 years have passed. This case is yet another example of the workman not being able to realise the benefits despite obtaining favourable awards before the Labour Court, which were also confirmed by this Court.
6. In view thereof, W.P. No.16313 of 2021 shall stand dismissed. W.P. No.24250 of 2017 stands allowed. The management, namely the Tamil Nadu
State Transport Corporation, represented by its General Manager, Villupuram Division Limited, Vellore, is directed to pay the benefits as computed by the Labour Court by order dated 30.06.2020 within a period of three months from the date of receipt of the web copy of the order, without waiting for the certified copy of the order. Consequently, connected miscellaneous petitions are closed. No costs.
