Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the second respondent to consider the petitioner's representation dated 03.10.2024 and provide adequate Police protection for conducting the yearly Aravaan festival from 12.11.2024 till 22.11.2024 at the existing Aravaan Temple in a smooth and safe manner without any disturbance.

ORDER

This Writ Petition is filed for issuance of a Writ of Mandamus to direct the second respondent to consider the petitioner's representation dated 03.10.2024 and provide adequate Police protection for conducting the yearly Aravaan festival from 12.11.2024 till 22.11.2024 at the existing Aravaan Temple in a smooth and safe manner without any disturbance.

2. Heard both sides and perused the materials available on record.

3. It is to be noted that the Police themselves cannot take action, unless the Revenue Divisional Officer (RDO) take action. Therefore, when the rival groups clash, it is for the RDO to conduct peace-committee-meeting. Thereafter only, they have to settle the issue.

4. In this case, the RDO had not been made as a party. The petitioner has 2 / 4

suppressed the facts and had not impleaded the RDO as a party.

5. Hence, this Writ Petition is dismissed. The petitioner is at liberty to work out his remedy in the manner known to law. There shall be no order as to costs.
