Sivasankari v. Gandhimathinathan

CMP No.25861 of 2023 in CMA SR No.140544 of 2023 N.ANAND VENKATESH,J Since the first respondent remained ex parte before the Tribunal below, notice to him has already been dispensed with.

Mr.J.Michael Visuvasam, learned counsel undertakes to file vakalat on behalf of the second respondent.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 489 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioners and the learned counsel for the second respondent and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 489 days is condoned.

5. It is made clear that for the period of delay of 489 days, the petitioners/appellants will not be entitled for any interest in the event of this Court enhancing the amount of compensation fixed by the Tribunal below.

6. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for second respondent shall also be printed in the cause-list.
