ORDER
On the face of the complaint given by one Mr.M.Devarajan alleging that the petitioner has forged the title documents of the property in the year 2003 and transferred the property in his name, a case has been registered by the respondent police and the petitioner herein was summoned to appear on 22.07.2023 for enquiry. The petitioner who appeared before the Investigation Officer for enquiry alleges that the police harassing him to re-transfer the property in the name of the defacto complainant which was sold by the defacto complainant and his son as early as on 27.03.2003 after receiving valuable consideration. Alleging that the police has harassing him unnecessarily, the present petition is filed.
2. The learned Government Advocate (Crl.Side) states that complaint regarding forgery of documents been under investigation in CSR. No.538 of 2023 dated 18.07.2023, pursuant to that, summon was issued to the petitioner and petitioner had furnished certain documents and they are now sent for expert opinion and some more documents required for forwarding the disputed documents for handwriting comparison. The petitioner herein who promised to produce those documents did not turned up but had filed the present petition falsely alleging that the Police has harassed him. The police has no intention to force the petitioner to re-transfer the property to the defacto complainant, but Page No.2/4
they are under the pursuit of investigating the complaint to know the genuineness of the complaint.
3. In view of the above submission, it is sufficient to direct the petitioner herein to appear on summon and produce the documents mentioned in the summon for the investigation agency to proceed with the investigation and arrive at a conclusion whether to file final report or close the complaint.
4. With the above directions, this Criminal Original Petition is disposed of.
