O R D E R

The petitioner, who was arrested and remanded to judicial custody on 10.07.2025 for the alleged offence under Section 8 (c) r/w 20(b) (ii)(B) of 1/5

NDPS Act, 1985 in Crime No.276 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 2 kgs of ganja for sale and the same has been seized by the respondent police. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that it is only one case against this petitioner in the State of Tamil Nadu and the quantity is 2kgs which is of intermediate quantity. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that this petitioner is arrayed as A1 in this case. Though the quantity of contraband seized from the petitioner which is of intermediate quantity, the petitioner is already involved in two other cases, out of which, one case is in the State of Andra Pradesh, which is relating to 71 kgs of ganja, which is commercial 2/5

quantity and the another case is in Tamilnadu i.e., R6, Kumaran Nagar Police Station/respondent police registered in Cr.No.329 of 2022 for the offence under Section Woman Missing Non Act on the file of the respondent police. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the fact that the petitioner is arrested on 10.07.2025, he is also having two previous case. Though it was disputed by the petitioner that he is not having any previous case at Andra Pradesh, I am not inclined to grant bail to this petitioner

7. Accordingly, this Criminal Original Petition is dismissed. 16.09.2025 Vv To 3/5
