PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondents to consider petitioner's representation dated 03.10.2024 seeking to retain the petitioner in the Government Middle School, Solaiyar estate where the petitioner is holding additional charge of noon meal organizer and pass orders.

ORDER

By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.

This petition is filed seeking to issue a Writ of Mandamus directing the Respondents to consider petitioner's representation dated 03.10.2024 seeking to retain the petitioner in the Government Middle School, Solaiyar estate, where the petitioner is holding additional charge of noon meal organizer and pass orders.

3. The facts of the case is that the petitioner is working as a Noon Meal Organiser in the Puratchi Thalaivar MGR Government High School, Kadamparai Power House, Valparai, Coimbatore since 24.08.2012. Whileso the second respondent vide order dated 28.08.2024 in Na.Ka.1180/2023/B2 directed the petitioner to hold an additional charge of Noon Meal Organiser at the Government Middle School, Solaiyar. However, the Government Middle School, Solaiyar is within a distance of 3 kms from the petitioner's residence, whereas, the Puratchi Thalaivar MGR Government High School, Kadamparai Power House, 2/5

Valparai, Coimbatore is far away from the petitioner's residence. It is also stated that there will be no legal impediment for the respondent to retain her in the Government Middle School, Solaiyar estate permanently instead of reverting her to Puratchi Thalaivar MGR Government High School, Kadampari Power House, Valparai, Coimbatore. Therefore, the petitioner gave a representation to the respondents on 03.10.2024 with regard to the said issue. However, the same was not considered till date. Hence, this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondents to consider petitioner's representation dated 03.10.2024 and pass orders.

5. The learned Special Government Pleader appearing for the respondents submits that they will consider the case of the petitioner on merits and in accordance with law.

6. Considering the facts and circumstances of the case and the 3/5

limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 03.10.2024 and pass orders on merits and in accordance with law within a period of Eight weeks from the date of receipt of a copy of this order.

7. With the above observations this writ petition stands disposed of. No order as to costs.
