PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, for a direction to the learned Principal District Munsif at Kallakurichi to dispose of O.S.No.211 of 2010 pending on its file within a time frame fixed by this Court. For Petitioner : Mr.C.Samivel

O R D E R

The civil revision petition seeks for expeditious disposal of O.S.No.211 of 2010 on the file of the learned Principal District Munsif at Kallakurichi.

2. When the matter came up for admission on 05.11.2024, I called for a report from the learned Trial Judge to state as to how long he requires to dispose of the said suit.

3. The learned Principal District Munsif, I Additional District Munsif (FAC) at Kallakurichi has submitted a report stating that he has taken full additional charge of I and II Additional District Munsif Courts at Kallakurichi from 06.05.2024. O.S.No.211 of 2010 is pending before the I Additional District Munsif Court at Kallakurichi. The case is pending for examination of further defendants' side witnesses. In the 2/4

meantime, the defendants filed I.A.No.251 of 2024 to send for the documents of original plaint in P.O.P.No.114 of 2010 and the same was allowed. The report further states that now the case is pending for awaiting records of original plaint in P.O.P.No.114 of 2010 and the case has been posted on 21.11.2024. Therefore, he requests three months time to dispose of the suit in O.S.No.211 of 2010.

4. Taking into consideration the report of the learned Trial Judge, there shall be a direction to the learned Principal District Munsif, I Additional District Munsif (FAC) at Kallakurichi to dispose of the suit in O.S.No.211 of 2010 within a period of four months from the date of receipt of a copy of this order.
