This Criminal Original Petition has been filed to call for the record of the said First Information Report No.277 of 2019 dated 29.04.2019 pending investigation on the file of the first respondent and quash the same. 1/4

2. The learned counsel for the petitioner submitted that petitioner is an innocent person and he is not involved in any such grievous offence as alleged in the First Information Report. He is implicated in this case, solely to implicate A1 and A2, and slap gundas against them. He further submitted that the petitioner is no way connected with A1 and A2 and other accused.

3. The learned Government Advocate (Criminal Side) submitted that investigation is pending in this case.

4. Heard the submissions of learned counsel for both sides.

5. This Court, on going through the Final Information Report finds that this petitioner along with other accused had waylaid the defacto complainant and abused him and robbed him the amount of Rs.12,500/-. Not only that, the petitioner and other accused have beaten the defacto complainant.

6. Therefore, it cannot be stated that there is no material for registering a case against the petitioner in this case. There is prima facie material available 2/4

against the petitioner for the investigation to the offences alleged in the First Information Report and most of them are cognizable offences.

7. In such view of the matter, this Criminal Original Petition is dismissed. The respondent Police is directed to expedite the investigation and file final report immediately.
