The present Petition has been filed under Section 528 of BNSS Act seeking prior permission of the Court to leave India and to go to Australia from 07.11.2024 to 04.12.2024.
2.The case of the Petitioner is that he was granted anticipatory bail by this Court in Crl.OP.No.20169 of 2024 on 11.09.2024 with one of the conditions that he should not leave India without prior permission of this Court. The present Petition has been filed seeking permission to go to Australia and attend the housewarming ceremony of his son. 3.Learned counsel for the Petitioner would submit that the Petitioner has got strong roots in India. He would further submit that the Petitioner is ready to obey any conditions imposed by this Court. He would further submit that the Petitioner intends to visit Australia from 07.11.2024 to 04.12.2024 and return to India on 04.12.2024. 4.Learned Government Advocate (Crl. Side) appearing for the Respondents 1 & 2 would submit that the investigation is pending. 5.Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on both sides and the 1/3
undertaking affidavit filed by the Petitioner, the Petitioner is permitted to leave India, on condition that he has to deposit a original sale deed either in his name or in his relatives or friends name to the face value of Rs.25,00,000/- (Rupees twenty five lakhs only) before the learned Judicial Magistrate, Thiruporur. After returning from Australia, the Petitioner is entitled to file a Petition before the learned Judicial Magistrate, Thiruporur seeking return of the said document and on Petition, the said document shall be returned to the Petitioner.
6.The Petitioner shall continue to comply with the conditions imposed by this Court in Crl.OP.No.20169 of 2024 on 11.09.2024, after returning from Australia. The Petitioner shall also give the address of the residence at Australia to the Investigating Officer through email. Accordingly, this Petition is ordered.
