This application has been filed to grant time to the petitioner/ defendant to challenge the validity of the registrations under Nos.404943, 484524 & 484525 by filing rectification petition under Section 47 & 57 of the Trademarks Act, 1999 upon framing an issue as regards to its validity.

2.Heard the learned counsels appearing on either side.

3. It is brought on record that a rectification application is also pending on the file of this Court in (T)OP(TM)/270/2023, (T)OP(TM)/271/2023 & (T)OP(TM)/272/2023.

4. In view of the aforesaid (T)OP's this application becomes infructuous and is accordingly dismissed.
