The petitioners who were arrested and remanded to judicial custody on 08.10.2023, registered by the respondent Police for the offences under Sections 6(4) of TNSC (RDCS) Order 1982 r/w 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.64 of 2023, seek bail.

2.The case of the prosecution is that the petitioners were illegally transporting 35 kgs ration rice bags in 30 bags which totally contains 1050 kgs. This rice was meant for public distribution through ration shop.

3.It is stated by the respondent that there is one previous case of similar nature against the petitioner.

4.The learned counsel for the petitioners stated that both the petitioners are brother and drivers.

5.But, however taking the fact that the earlier case of similar nature and this is the repetition of the same offence and also taking into consideration the quantity of the PDS rice seized, this Court is not inclined to grant bail to the petitioners.
