(Order of the Court was made by The Chief Justice) The writ petition has been filed seeking issuance of a writ of certiorarified mandamus to call for the records pertaining to impugned possession notice in Ref.: Tirupur/RESEC/POSS/Hanuman Knit Fashion / 2024-25 dated 03.08.2024 and impugned auction notice in Ref. E- Auction Sale / Hanuman Knit fashion / 2024 dated 18.09.2024 issued by the Respondent bank quash the same and direct the Respondent Bank to adhere to framework for Revival and Rehabilitation of MSMEs issued vide Notification dated 29.05.2015 issued by the Ministry of MSME and Reserve Bank of India (Lending to Micro , Small and Medium Enterprises (MSME) Sector) directions 2016 vide notification dated 21.07.2016.
2. The relief sought in the writ petition cannot be granted in view of the fact that the Revival and Rehabilitation Application has been rejected subsequent to filing of the writ petition. The rejection gives a fresh cause of action to the petitioner. This petition is rendered infructuous.
3. Accordingly, the writ petition is dismissed with liberty to the petitioner to challenge the dismissal of Revival and Rehabilitation Application before the appropriate forum in accordance with law, if so advised. No costs. The connected miscellaneous petition is closed.
