PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., pleased to set aside and modify the condition imposed in Crl.M.P.No.81 of 2023 dated 22.02.2023 by the Sessions Judge, Fast Track, Mahila Court, Tiruvarur and release the petitioner on her own bond. O R D E R

This petition has been filed seeking modification of the condition imposed while granting bail in Crl.M.P.No.1785 of 2023 by the learned Principal Sessions Judge, Tiruvarur by an order dated 22.11.2022, whereby, it had been directed that the petitioner should execute a bond for a sum of Rs.15,000/- and also produce two sureties each for the likesum to the satisfaction of the concerned Magistrate.

2. It is the case of the respondent that the petitioner has been charged for the offence punishable under Section 302 I.P.C for committing the murder of her own daughter-in-law. Subsequently, her son committed suicide and the husband also died. There are 3 daughters but they and other relatives did not come forward to give surety to the petitioner herein. The age of the petitioner is 65 years. It is also seen that though the order granting bail was passed more than a year back the same is still pending, owing to non-production of surety. It is also stated that the trial has commenced and this petition has also been filed through Legal-Aid.

3. Taking all the surrounding facts into consideration, the condition imposed with respect to production of the sureties is modified to the effect that the petitioner shall be released on execution of own bond, with a direction to appear before the trial Court, on every Monday at 10.30a.m., and during the court hearing dates, till the completion of the trial.

4. This petition is ordered accordingly.
