This Criminal Original Petition has been filed seeking a direction to the second respondent herein to not to harass the petitioner in the guise of Page No.1 of 4
enquiry on the basis of the petitioner's representation dated 04.12.2022 made to the first respondent herein.
2. The contention of the petitioner is that on 03.12.2022, the second respondent police barged into the petitioner's house and attempted to arrest her. Further, they had also threatened that she will be arrested for being second wife of one Rajesh, who is the accused in Crime No.19 of 2022. The learned counsel further submitted that due to the act of the police, the house owner, forcing the petitioner to vacate the house. For this reason the above petition has been filed.
3. Learned Additional Public Prosecutor submitted that the petitioner is not an accused in Crime No.19/2022. She was called for enquiry, since there is an allegation against her that she is the second wife of the accused Rajesh. Further submitted that now investigation in this case has been completed, charge sheet made ready and shortly to be filed before Judicial Magistrate No.I, Ponneri. In the charge sheet there are totally 16 witnesses listed. The petitioner is shown as L.W.12. Since the investigation is completed, the presence of the petitioner is no more required. In view of the above facts, the apprehension of the petitioner no more exists and the Page No.2 of 4
petitioner is only a witness in Crime No.19 of 2022.
