Crl.MP.No.16759 of 2019 in Crl.R.C.SR.No.56002 of 2019 A.D.JAGADISH CHANDIRA, J., The Criminal Miscellaneous Petition has been filed, seeking to condone the delay of 688 days in preferring the above criminal revision in Crl.R.C.SR.No.56002 of 2019, against the order dated 21.09.2017, made in C.A.No.71 of 2016, by the I Additional Sessions Court, Erode. The respondent/complainant is present before this Court today. Mr.K.Vanangamudi, learned counsel undertakes to file vakalat for the respondent/complainant.
Heard both sides.
The learned counsel for the petitioner would submit that though, the cheque amount is for Rs.3,00,000/-, the respondent/complainant has received an amount of Rs.2,00,000/- from the petitioner/accused, towards as full and final settlement. The respondent/complainant has also filed Full Satisfaction Memo. Having been satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered and the delay of 688 days in preferring the above criminal revision in Crl.R.C.SR.No.56002 of 2019, against the order dated 21.09.2017, made in C.A.No.71 of 2016, by the I Additional Sessions Court, Erode, is hereby condoned.
The Registry is directed to number the above criminal revision in Crl.R.C.SR.No.56002 of 2019, if the papers are otherwise in order and list the same for admission on 28.11.2019.
