O R D E R

This Writ Petition has been filed to direct the respondent to consider and dispose of the petitioner's representation dated 21.08.2017 so as to provide employment to the petitioner as Anganwadi Worker in the Integrated Child Development Service Department under the Rights of persons with disabilities Act, 2016.

2. The case of the writ petitioner is that the respondent invited the application for filling up of vacant post of Anganwadi Worker. The petitioner gave the representation on 21.08.2017 seeking appointment through reservation invoking the provisions of the Rights of Persons with Disabilities Act, 2016. It is the specific case that the said representation ought to have been considered and disposed of.

3. The respondent has filed a counter stating that they have already examined the application of the writ petitioner and the post of Mini Anganwadi Worker has been kept vacant till date. The case of the writ petitioner is that the reservation for the candidate like the writ petitioner is 2/4

mandatory and one post ought to have been reserved by the respondent and the petitioner's application ought to have been considered objectionably.

In view of the above facts and circumstances of the case, this Court feels deems it sufficient to direct the respondent to dispose of the petitioner's representation dated 21.08.2017 on merits and if necessary accord the present hearing to the writ petitioner before passing the final orders. The statement of the respondent in the counter affidavit that the post of Mini Anganwadi Worker has been kept vacant is recorded and the respondent would be at liberty to fill up the said vacancy consequent to the final order has been passed on the petitioner's representation within a period of four weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. No order as to costs.
