ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The allegations in this case are that on 15.07.2016, the accused protested for the reasons that there were no basic facilities in the Government Polytechnic College without due permission. The case was registered in crime No.367 of 2016 for the alleged offences under Sections 143, 341 and 188 IPC. Page No.1 of 3

It can be seen that the allegations are in the nature of democratic protest, further, the offence under section 188 IPC has been taken on file by way of police report and thirdly, summon has not been served and even if summons is served on a future date, it would impinge upon the right to a speedy trial. 3.Accordingly, the case in S.T.C.No.1157 of 2017 on the file of the Judicial Magistrate Court, Thiruthuraipoondi Taluk, Tiruvarur, stands quashed. This Suo Motu Transfer Case is disposed of. 07.10.2025 sms electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
