The learned counsel for the applicant would submit that on the date of passing of order, the defendants 19, 22, 26 & 30 remained unserved. He would submit that he had also taken out a Memo as on the date of the order that he had identified the correct address of the 30th defendant and they have also taken steps to locate the address of defendants 19, 22 & 26. 2.

Considering the statement made by the learned counsel for the applicant that by within a period of four (4) weeks they would trace the correct address of the defendants 19,22 & 26 and also the submission that a fresh batta will be filed with respect to 30th defendant within a period of one week from today and also file batta with respect to defendants 19,22 & 26 within a period of four (4) weeks from today to the correct address and the suit shall stand restored against defendants 19,22,26 & 30. 3.

Considering the fact that the suit had been dismissed only as against the unserved defendants and the interim injunction still continues as against the served defendants, the injunction granted against the unserved https://www.mhc.tn.gov.in/judis defendants which was dismissed and also the application for Page No. 1 of 2
