ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.162 of 2017. The allegation in this case is that the accused forming A and B party were fighting against each other. It can be seen that the case was registered under Section 160 of I.P.C. Page No.1 of 3

Considering the law and order situation, now eight years have passed by, no useful purpose will be served keeping the matter pending. It is informed that the accused (A2) died and A1 & A3 regularly attending the court.

3. Considering the nature of the allegation, and since the accused (A1 and A3) have been facing the case since 2017, any further continuation of the trial would impinge upon their right to a speedy trial of the accused and no useful purpose would be served.

4. Accordingly, the case in STC. No.8 of 2023 of Additional Mahila Court, Udhagamandalam Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of.

19.09.2025 mtl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
