The petitioner seeks bail in Crime No.W.L.O.R.No.30 of 2023, registered by the respondent police for the offences punishable under Sections 39(1)(a)(b), ©, (d), 39(3) (a)(b), 44, 48A, 48(b)(ii) 49A, 49B, 50 r/w 51 of Wild Life Protection Act, 1972, for keeping Assam Footed Turtles. The petitioner was arrested on 30.09.2023. 2.It is the case of the respondent that they received information about transporting of Indian Tent Turtles and when they checked the train at Perambur Railway Station, they seized 88 numbers of Assam Footed Turtles and 103 numbers of Indian Tent Turtles in trolley bags from the petitioner herein. The seizure had been from the possession of the petitioner herein.

3.The learned counsel for the petitioner stated that Assam Footed Turtle is not an endangered species and that penalty can be imposed but still, the fact of transporting of it all the way from West Bengal to Tamil Nadu shows intent.

4. Taking into consideration all these factors, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
