The petitioner/A2 is an accused in Spl.S.C.No.159 of 2023, now pending before the Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Chengalpattu District, seeks bail. The charges, which had been framed are under Sections 3(2)a, 4(1), 5(1)a, 6(1), 7(1) of ITP Act, @ Sections S.5(1), 5(p) r/w 6(1) of POCSO Act, 2012. It is stated that the petitioner has been in custody from 26.06.2023.

2. The learned counsel for the petitioner stated that A1, A3, A4 and A5 had been granted bail and that the petitioner is A2 and seeks similar relief.

3. It is also stated that the charge sheet had been filed and the stage is at issuing summons to the accused persons but let the examination of the victims be completed. This is so because in the way in the order granting bail to the other accused, it has been very specifically observed by a learned Single Judge of this Court that the petitioner

herein is the lessee of the hotel, where the victim child/victim women were rescued and that it is the petitioner herein, who lured the victims to the said hotel.

4. In view of that particular fact and even though final report had been filed and even though other accused had been granted bail, I am not inclined to grant bail to the petitioner herein at this stage.

5. Accordingly, this Criminal Original Petition stands dismissed. A fresh application may be filed after examination of the victim child/victim women.
