The petitioner seeks leave to file an appeal against the order dismissing his complaint for non-appearance under Section 256 of the Cr.P.C. and consequential acquittal of the respondent. 2.Mr.B.Damodaran, the learned counsel for the petitioner/appellant, would submit that the complainant was continuously represented by his counsel and only on one hearing, i.e., on 23.08.2024, he had not appeared, which is neither willful nor wanton.

3. It is seen that the learned Metropolitan Magistrate, Fast Track-II, Egmore @ Allikulam, has not issued notice of appearance to the complainant. Hence, leave is granted to file an appeal.

4. Registry is directed to number the appeal and post for admission if it is otherwise in order.
