C.M.P.No.24319 of 2019 in C.M.A.Sr.No.141248 of 2019 C.M.P.No.24319 of 2019 in C.M.A.Sr.No.141248 of 2019 R.SUBBIAH, J and T.KRISHNAVALLI, J [Order of the Court was made by R.SUBBIAH, J ] This Petition has been filed to permit the petitioner to exempt from payment of Court fee of a sum of Rs.29,000/- in the above appeal.

2. Petitioner suffered an accident on 18.08.2015 at about 08.30 p.m., owing to which she suffered grievous injuries and lost her right vision. Petitioner filed M.C.O.P.No.3333 of 2016 on the file of Motor Accident Claims Tribunal, Principal Special Judge, Chennai, seeking compensation. Tribunal, under order dated 17.12.2018, awarded a sum of Rs.13,99,500/- towards compensation. Aggrieved by the same, the present Appeal has been filed seeking enhancement of compensation.

3. It is the case of the petitioner that respondent/Transport Corporation has not deposited any amount till date and she is unable the pay the Court fee payable for entertaining the Civil Miscellaneous Appeal. Petitioner also undertakes to pay the Court fee immediately after disposal of the present Civil Miscellaneous Appeal. http://www.judis.nic.in 1/2

4. Having regard to the above facts, this Court directs the petitioner to pay 1/3rd of the Court fee payable, for the present. However, it is made clear that as and when the Appeal is disposed of, petitioner has to pay the balance Court fee payable by her.
