When the matter was taken up for hearing, learned counsel for the petitioner submitted that the first respondent has filed an Interlocutory application No.6 of 2018 in O.A.Sr.No.35 of 2018 to condone the delay of 707 days in filing the said original application and the same was allowed on 05.12.2018 with a payment of costs of Rs.700/-., against which, the petitioner has filed the present Civil Revision Petition. Subsequently, the aforesaid O.A.Sr.No.35 of 2018 has been numbered as O.A.No.13 of 2018 on the file of Court of Special Judge for the Tamil Nadu Protection of Interest of Depositors (In Financial Establishments) Act, 1997 at Chennai and the same was dismissed on 07.01.2023.

2. Learned counsel for the petitioner would further submit that the subject matter O.A.No.13 of 2018 itself was dismissed on 07.01.2023, this matter has become infructuous and nothing survives in this petition for further adjudication.

3. In view of the above submission made by the learned counsel for the petitioner, this Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also closed. 30.11.2023 vm Index :
