The petitioner herein seeks anticipatory bail in Crime No.154 of 2022 registered by the respondent Police for the offence under Section 379 IPC on the basis of the complaint dated 26.05.2022.

2.The learned counsel for the petitioner stated that, he has been falsely implicated as an accused in this case. Apprehending arrest from the respondent police, he seeks bail to the petitioner.

3.The learned Government Advocate (Criminal side) stated that the defacto complainant had gone towards Mallur to Mettur carrying cash of Rs.4,00,000/- and when he stopped the bike on the road side, the accused had come and diverted the attention of the defacto complainant and stolen Rs.4,00,000/- from him. The 1st accused had been arrested and remanded to judicial custody on 12.02.2023. 1/3

4.The learned counsel for the petitioner states that on the basis of the confession of the 1st accused, the petitioner had been arrayed as the accused. An amount of Rs.1,00,000/- had been recovered by the respondent police. 5.There is a doubt whether the 1st accused is the son or son in law of this petitioner. Be that as it may, only an amount of Rs.1,00,000/- had been recovered and balance Rs.3,00,000/- has not been recovered. Therefore, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
