ORDER

This petition has been filed to relax the condition that the petitioner shall appear before the concerned Trial Court on all hearing dates without fail imposed on Appellant/Accused in Cr.A.No.1303/2024 dated 12.11.2024.

2. The learned counsel for the petitioner submits that the petitioner is advocate by profession and he appeared before the trial Court for two times in a month, due to which he was not able to do his advocate profession. Hence, he prays to relax the condition imposed on the petitioner.

3. The learned Government Advocate admits that the petitioner is advocate and there is no previous case pending against the petitioner and the petitioner complied with the conditions regularly.

4. Considering nature of the petitioner's profession, this Court is inclined to modify the condition imposed on the petitioner. Accordingly, the petitioner is directed to report before the Trial Court whenever the trial judge insisted him to appear. if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court. He is directed to comply with the condition without any deviation.
