(Order of the Court was made by Dr.ANITA SUMANTH.,J.) This petition has been filed by way of abundant caution seeking condonation of delay of 408 days in filing the Original Side Appeal.

2. From the original order, we see that a copy application was filed on 04.01.2021 and ultimately the order was made ready and issued only on 18.08.2022. However, the appeal has been filed on 06.06.2022 based on the web copy of the order even prior to the issuance of the certified copy of the order.

3. In such circumstances, we are of the view that there could be no delay, since the appeal has admittedly been filed on 06.06.2022, even prior to the date when the certified copy of the order made ready and issued.

4. Hence, this Miscellaneous Petition is unnecessary and the same is closed. Registry is directed to number the Original Side Appeal, if it is otherwise in order and list the same for admission.
