ORDER

This Criminal Original Petition has been filed to call for the records pertaining to the first information report in Cr.No.6 of 2024 on the file of the 1st respondent police and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.

3. Learned counsel for the petitioner submitted that other than being the wife of A1, the petitioner has no role in the commission of offence. The petitioner never involved in her husband's official work.

4. Learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that the petitioner is arrayed as A2 who is the wife of A1 in F.I.R No.6 of 2024 for the offences under Sections 406, 420, 465, 468 and 471 of the IPC. A1 was working as a Manager quality control, along with other accused had committed criminal breach of trust and misappropriated 9 Kg of gold from the company over a period of time, thereby causing loss to the company. A1 had utilized the misappropriated funds to purchase several plots 2/5

in his name. Further, he submitted that though there is no specific overt act as against the petitioner, during the investigation, it was found that A1 had purchased 19 plots by using the misappropriated amount and 14 plots were in the name of the petitioner. Investigation is almost completed. Final report is yet to be filed.

5. Merely because specific allegation is not found in the F.I.R as against the petitioner alone may not be the ground to quash the F.I.R. Taking note of the allegations in its entirety, this Court does not find any merit in this criminal original petition. The respondent-Police is directed to complete the investigation and file a charge sheet before the concerned court as expeditiously as possible.

6. With the abovesaid direction, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 17-09-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
