The learned counsel for the petitioner after arguing the case for a considerable length of time and when the learned Special Government Pleader appearing on behalf of the official respondents raised an objection that there is an objection from the 5th respondent for settling the compensation in favour of the petitioner, the learned counsel for the petitioner has chosen to withdraw the writ petition.
2. In the event of objection for settling the compensation the matter has to be referred for adjudication before the competent Subordinate Court under the provisions of the National Highways Act, 1956. The proposal in this regard is settled by this Court in the case of D.Kannan vs. The Director of Planning, National Highways Authority of India, reported in (2007) 3 L.W. 747. However, the petitioner seeks permission to withdraw the writ petition. Accordingly, the writ petition stands dismissed as withdrawn. No costs.
