It is stated that the statement under Section 164(5) Cr.P.C., has not yet been recorded.

2.At this juncture, the learned Counsel appearing for the petitioner seeks permission of this Court to withdraw this petition with liberty and he has also made the following endorsement to that effect.

"Petitioner permit withdraw the anticipatory bail petition"

3.In view of the above submission and also the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn with liberty to file a fresh petition as soon as the statement under Section 164(5) Cr.P.C., is recorded.
