Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the fifth respondent to send revised pension proposal to the second respondent in the light of the order passed by the fourth respondent in his proceedings in O.Mu.No.030176/AKaTha/2024, dated 14.06.2024 and sanction the full pension and other terminal benefits by considering the petitioner's representation dated 19.06.2024.

This writ petition has been filed seeking issuance of a writ of mandamus directing the fifth respondent to send the revised pension proposal to the second respondent in the light of the order passed by the fourth respondent through proceedings dated 14.06.2024 and to sanction full pension and other terminal benefits to the petitioner by considering the petitioner's representation dated 19.06.2024. 2/6

2. Heard Mr.P.Murali, learned counsel for petitioner, Mrs.S.Mythreye Chandru, learned Special Government Pleader appearing for respondents 1, 3 to 5 and Mrs.J.Sreevidhya, learned Standing Counsel appearing for second respondent.

3. The case of the petitioner is that he was appointed as Secondary Grade Teacher in the year 1990. Thereafter, he was promoted periodically and ultimately, the petitioner reached the post of Middle School Headmaster in the year 2008. The petitioner retired from service on 31.05.2024. The grievance of the petitioner is that he is entitled for sanction of full pension and other terminal benefits in line with the proceedings of the fourth respondent dated 14.06.2024. The representation made by the petitioner to implement the same did not evoke any response. Therefore, the petitioner is seeking for a direction to the fifth respondent to send the revised pension proposal to the second respondent to enable the petitioner to get full pension and other terminal benefits.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction 3/6

to the fifth respondent to deal with the representation made by the petitioner on 19.06.2024 in the light of the order passed by the fourth respondent and if the petitioner is found eligible, the revised pension proposal shall be forwarded to the second respondent. On receipt of the same, the second respondent shall pass final orders. The entire process shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to respondents 2 and 5 along with all the relevant records and also a copy of this order.

This writ petition is disposed of with the above direction. No costs.
