Prayer : Writ Petition under Article 226 of the Constitution praying for a Writ of Mandamus directing the 1st to 5th respondents to remove the encroachment made by the 6th respondent in the public road situated at the 4th cross street, LIC Nagar, Madipakkam, Chennai-600 091 by considering petitioner representation dated 25.10.2024.

The prayer sought for herein is for a Writ of Mandamus directing the 1st to 5th respondents to remove the encroachment made by the 6th respondent in the public road situated at the 4th cross street, LIC Nagar, Madipakkam, Chennai600 091 by considering petitioner representation dated 25.10.2024.
2. It is the allegation on the part of the petitioner that the sixth respondent has encroached upon a public road situated at 4th cross street, LIC Nagar, Madipakkam, Chennai-600 091 and in order to remove such encroachment, he has given a representation on 25.10.2024 to the official respondents. However,
the same since has not been considered and no decision so far has been taken by the respondents, he has approached this Court by filing the present writ petition.
3. Heard Mr.S.Mugesh, learned counsel for the petitioner and Mr.T.Chezhian, learned Additional Government Pleader for the respondents 1 to
5. In view of the order that is going to be passed in this writ petition, notice to the 6th respondent is dispensed with.
4. Learned Government Advocate appearing for the official respondents would submit that the representation given by the petitioner dated 25.10.2024 would be considered and suitable action in accordance with law would be taken within a time frame that may be stipulated by this Court.
5. Having regard to the said stand taken by the learned Government Advocate, this Court is inclined to dispose of this writ petition with a direction to the respondents 4 and 5 to consider the representation of the petitioner dated 25.10.2024 and take action thereon with regard to the alleged encroachment on the part of the 6th respondent in the public road and in this context, after giving notice to the learned counsel for the petitioner as well as the 6th respondent, the
street concerned can be inspected by the said two respondents and if they find that any encroachment is made by the 6th respondent or any third party in the public road, the same can be removed in accordance with law. The needful as indicated above shall be undertaken by the official respondents within a period of two months from the date of receipt of a copy of this order.
