C.M.P.No.449 of 2024 in S.A.Sr.No.38142 of 2015 P.T.ASHA, J., The above petition is filed for condoning the delay of 2753 days in representing the above Second Appeal in S.A.Sr.No.38142 of 2015.

2. The appellants herein are the plaintiffs who have concurrently lost the suit for partition in both the Courts below.

3. The reasons for the delay has been set out by the petitioners/appellants in paragraph nos.3 to 5 of the affidavit filed in support of the condone delay petition.

4. The reasons given in the affidavit clearly shows that the delay was beyond the control of the petitioners/appellants. However, taking into account the fact that the delay is of 2753 days, the same is allowed on costs of Rs.1,500/- which shall be paid by the petitioners/appellants to the Tamilnadu Advocate's Clerk's Association on or before 1/4
