ORDER

This Criminal Miscellaneous Petition has been filed seeking to cancel the anticipatory bail granted to the respondents 1 to 3 herein by this Court in Crl.O.P.No. 9167 of 2025, vide order dated 08.04.2025. 2.The learned Counsel for the petitioner submitted that the petitioner herein is the de-facto complainant in this case and the private respondents 1 to 3 herein were granted anticipatory bail with conditions that the respondents 1 to 3 shall not involve in similar activities and at any point of time, they shall not interfere and create trouble to the Ashram. However, the respondents 1 to 3 herein have circulated derogatory pamphlets against the Ashram. In this regard, the petitioner/de-facto complainant also filed a complaint before the fourth respondent police and since there is a violation of the condition imposed while granting anticipatory bail, the petitioner/de-facto complainant seeks for cancellation of the bail order.

3.The learned Counsel for the Respondent Nos. 1 to 3/A1 to A3 submitted that they have not involved in any alleged activities stated in the petition, some of the villagers have issued pamphlets against the Ashram and the respondents have no role in it. Further he submitted that the respondents 1 2/5

to 3 are ready to co-operate for investigation and with a false allegations, this petition has been filed. Hence, he prayed to dismiss the application. 4.The learned Government Advocate [Criminal Side] appearing for the 4th respondent submitted that the complaint lodged by one of the witnesses in this case was enquired and the same was closed after due enquiry. He further submitted that the bail petitioners have already complied with the conditions imposed by this Court.

5. I have also gone through the allegations made in the petition and also the other conditions imposed by this Court in Crl.O.P.No. 9167 of 2025 vide order dated 08.04.2025. While granting anticipatory bail to the bail petitioners, they have filed an affidavit stating that they will not indulge in similar activities to the Ashram. Now, it is alleged that they have violated the conditions and also the same is denied by the bail petitioners. The statement of the Government Advocate revealed that the complaint regarding the violation of the bail conditions was lodged before the fourth respondent police and the petition enquiry pending was enquired and it was also closed, since there was no such incident has occurred. Further, it is also stated that some of the bail petitioners have not involved in any issuance of pamphlets. 3/5

6.Considering the fact that the anticipatory bail was granted to the respondents 1 to 3 as early as in the month of May, 2025 and now, we are in January, 2026 and that investigation is pending, I am not inclined to cancel the anticipatory bail to the respondents 1 to 3 herein for the reasons stated above. 7.Accordingly, this Criminal Miscellaneous Petition is dismissed. 19.01.2026 Index: Yes/No Internet: Yes/No Speaking/Non-Speaking order MSM To The Inspector of Police, Sulur Police Station Coimbatore.
