ORDER

This Criminal Original Petition has been filed by the defacto complainant seeking transfer of the FIR in Crime No.23 of 2025 from the second respondent to any other competent authority.

2. The grievance of the petitioner is that the first accused , on the promise of marriage, had physical relationship with her. As a result, she became pregnant and later, aborted on the advice of the first accused. Subsequently, the engagement of first accused with another woman was arranged. However, the first respondent police neither took any action nor made any effort to secure the first accused.

3. The learned Government Advocate (crl.side) appearing for respondents would submit that this Court, vide order dated 28.08.2025, granted an interim

stay of further investigation on the petition filed by the first accused seeking quash of the FIR in Crime No.23 of 2025.

Admittedly, this Court granted an order of interim stay on 28.08.2025, considering the fact that the very allegation in the First Information Report indicate that the first accused and the defacto complaint were in a love affair and subsequently their relationship had broken. Hence, this Court is of the view that the question of further investigation does not arise and there is no merit in this petition.

5. Accordingly, this Criminal Original Petition is dismissed . 29-08-2025 mrp
