PRAYER - The Criminal Miscellaneous Petition is filed under Section 482 Cr.PC/528 BNSS to modify the order in Crl.OP.No.3575 of 2025 dated 12.02.2025 on the file of Honourable Madras High Court in so far as the condition in para No.4(ii) of the said order directing the petitioner to deposit the original RC Book and consequently issue a direction to return of the original RC book for a month pertaining to Tipper Lorry bearing Registration No.TN 39 BR 2563, Ashok Leyland Tipper Lorry, to petitioner.

ORDER

The above Criminal Miscellaneous Petition has been filed to seek a modification of the order passed by this Court in Crl.O.P. No. 3575 of 2025, dated 12.02.2025, and for a direction to return the original Registration Certificate of the vehicle bearing Registration No. TN 39 BR 2563 for a period of one month.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner seeks the return of the original Registration Certificate for the vehicle bearing Registration No.TN 39 BR 2563, in order to obtain the necessary fitness certificates pertaining to the said vehicle.

4. Considering the facts and circumstances of the case, the Trial 2/4

Court is directed to return the original Registration Certificate of the vehicle bearing Registration No.TN 39 BR 2563 to the petitioner for the period of 1 month from the date of receipt of a copy of this order. Thereafter, the petitioner shall surrender the original Registration Certificate of the vehicle bearing Registration No.TN 39 BR 2563 before the Trial Court on or before 31.11.2025.

5. With the above direction, the Miscellaneous Petition is disposed of.
