The petitioner is A3 in Crime No.63 of 2023, registered under Sections 6 (4) of Tamil Nadu Scheduled Commodities (RDCS) order 1982 read with Section 7 (1)(a)(ii) of Essential Commodities Act, 1955. 2.It is stated that the petitioner and the other accused/A1 & A2 were found in possession of 2750 Kgs of PDS rice. In so far as A1 & A2 are concerned, anticipatory bail was granted by the learned Single Judge of this Court, in Crl.O.P.No.10712 of 2023, by an order dated 10.05.2023, wherein, they had been directed to deposit a sum of Rs.10,000/- as non-refundable deposit to the credit of the District Revenue Officer, Krishnagiri. 3.The learned Government Advocate (Crl.Side) appearing on behalf of the respondent stated that the petitioner is a collection agent of the rice. Therefore he can be termed as a primary person in support of the transport of PDS rice.
4.The quantity of rice is quite substantial, but the only factor which pervades in my mind is the granting of anticipatory bail to A1 and A2. It is 1/3
also stated that there is one previous case against the petitioner of similar in nature and if this particular FIR had been registered, there is one subsequent case also registered against the petitioner herein of similar nature. These are the factors which have to be considered eventhough anticipatory bail is granted to A1 and A2. Therefore, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 16.11.2023 sli 2/3
